How to Get out of a Cellular Service Contract

In the U.S., it can be easier to end a marriage than to leave a loveless relationship with Verizon or Cingular. No, you don't have to move to SIM card swapping Europe. Try these guerrilla tactics to get out of your service contract.

    Steps
Be a squeaky wheel. Say you want out because the service isn't up to par. (And really, is it?) Then back that up by filing official complaints online with the Federal Trade Commission and the Better Business Bureau.
Get a lemon. Get a known problematic phone, complain 3 times, be let out of a contract due to your local lemon law.
Try a market-based fix. Some companies such as Celltradeusa.com match unhappy mobile customers with people who'd like to sign up - at a discount, of course. You'll pay a $20 fee to sell your contract on the block.
Look for your provider to bury changes to Terms of Service with your bill. Quite often providers modify their service plans, much of the time the modification is a benefit. It doesn't matter, this voids the previous contract. Read the small print on those inserts included with your bill, it will spell out that you have 30 days (may vary on where you live) to cancel your contract with no charge simply because they changed the contract.
Do a radical move. While potentially extreme, these solutions could free you of the contract:

Get off the grid. Study your provider's coverage map and find a town (maybe in Alaska?) with absolutely no service. Then tell the company you're moving there. They're not legally required to cut you loose, but frustrated consumers have reported success.
Join the army. If you are a member of the US Armed Services and you receive orders to somewhere the company doesn't provide service (it doesn't have to be Iraq) they are obligated to cancel your contract free of charge. Keep in mind, you'll have to provide a copy of your official orders. (However, if you're moving to Kenosha, WI and still want to get out of your contract, you can just black out the location and tell the provider you're being shipped to a CLASSIFIED location. It works.)
Over use Free Roaming. Most phones come with free roaming now. But it's not actually free. The company pays it for you. So all you do is go to an area that is considered roaming (and when you have free nights or weekends) and place a long (5 hours?) phone call to "Moviefone" or something along those lines. You can also set your phone to only roam and instead of utilizing its own network it will search for others and utilize those. This will start adding up for them in the fees they have to pay to the service provider in that area and they will kick you out of the contract. Too bad.
Try talking their language. Call up to complain about the lousy reception you've been getting ever since the end of that 30-day lock in period. Tell them that because they are no longer providing the same service for which you contracted, the contract is void and unenforceable; you just aren't gonna pay anymore, and forget that "penalty clause," because that's against the law in most states (check with a local attorney). Be persistent on this point. When they mention collections (and they will) use the words "abuse of process." In most states this will stop a cell company dead, because it means you will consider suing them for punitive damages if they do anything to affect your credit based on their (in your mind, void) contract. Again, check with a local attorney.
Shrink your plan. As a last resort, cut back to the bare minimum the provider allows and drop any frills, like picture-messaging. Depending on the number of months you have left, this could be cheaper than paying the typically prorated termination fee, which can often run up to $300. However, at some cellular companies changing your plan, even to reduce it, may extend it for at least another year, so do the math first to make certain it will actually save you money.

    Tips
Please be aware that some of these tactics may require deception on your part. You may wish to weigh the advantages of getting out of your contract against the value of a clear conscience.
If you have a contract with "Unlimited Nights and Weekends", then anything that the carrier does, or doesn't do, to limit the number of minutes you could use during that period is a potential contract violation on the carrier's part. This might work if you consistently receive 'all circuits are busy now' messages or poorer reception than advertised on their coverage maps. Plus it has the added value of being the truth.

    Warnings
Not all contracts provide free roaming. Make sure to check before placing a lengthy roaming call. If it's not free in your contract, it will cost you a fortune.
Some carriers will charge you a hefty Early Termination Fee if they kick you off for excessive roaming. However, your insistence on satisfaction may help you avoid this charge.
Remember; you haven't heard the last word until an executive or a court says you have.

How to Buy the Right Mobile Phone

To buy the right cell (mobile) phone you will need to take a variety of factors into consideration. There are many cell phones available, and some are definitely better than others. Not all cell phones are intended for the same end user though.

      Steps
If you plan on purchasing a cell phone at a discounted price by signing a contract with a mobile phone carrier, it is important to first choose the carrier. Factors to take into account when choosing a carrier are coverage, price, texting/web/multimedia plans, customer service ratings.
Once you've determined a carrier, or if you will be purchasing an unlocked phone at full retail price, use a phone finder such as the one on Phone Scoop's website (listed in External Links).
If you are a non-technical user (you want to use the cell phone exclusively as a phone, not a handheld game console or pocket-pc), then features such as a camera, mp3 ring tones, video playback and messaging are not needed.
If you are a mid-range user, look at phones that have features such as a camera or mp3 ring tone support. Mid-range users tend not to purchase phones with multimedia players as these tend to add a significant cost increase.
If you are a high-end user, look into features such as mp3 playback, support for trans-flash expansion cards, a camera over 1 megapixel, video playback, or bluetooth.
Decide what you want, what you will use the phone for, and most importantly what kind of cell phone user you are.
Consider the type of person you are. Ask yourself if you misplace things often or if you drop things often. Choose a cell phone that is covered by cell phone insurance. An additional fee is required per month but it will save you hundreds of dollars if your phone is lost, stolen or if there is any physical or liquid damage.

      Tips
Purchase accessories from a corporate store of your cell phone provider because there is a separate warranty for them. If you buy a headset on the street for five dollars you can't take it back if it breaks. At a corporate store you may pay more but it can be exchanged through the warranty program for 1 full year. Always keep a receipt.

      Warnings
Do not go out and "impulse buy" a cell phone. This will most likely result in purchasing a phone with too little/many features.
Different phones give off different amounts of radiation, if you worry about that sort of thing.
Different phones also get different reception, so you could have a carrier with really good service, but a phone with poor reception and sound quality! Check this out too.

        tip:
if you do not want to get into a contract, buying a phone at the dealer that is also the service provider will cost u much more, since u will be paying on a month to month basis and can get out anytime, i have found ebay to be great in finding the right phone from your service provider, but at a much cheaper cost, u just go with the hardware to the service provider and they hook u up either free or a small charge, it surely beats the high cost of a new phone in the store when u can beat it with a fraction of the cost online

Mobile TV predicted to be a hit

(BBC) TV could overtake gaming and music as the consumer's favoured application for mobile phones, according to research.

Services in Japan, South Korea and Italy are attracting millions, confounding critics who said people would not watch TV on a small device.
But consumers remain confused by what is on offer, as competing service offer different content and quality.
For the UK, a shortage of spectrum needed for mobile TV means adoption of services might have to wait until 2012.
                          Money-spinner
Research firm Screen Digest forecasts that mobile TV will put gaming and music in the shade. It predicted that there will be 140 million global subscribers generating revenue of £3.1bn by 2011.
"There has been a lot of cynicism about mobile TV and the big unanswered question has been whether people would watch it. For us that has been answered," said Dave MacQueen, senior mobile analyst with Screen Digest.
A slow-down in mobile gaming and the fact that music via mobiles is unlikely to be a money-spinner for operators as people continue to 'side-load' music from their PCs, makes TV the best option for operators to make money, thinks Mr MacQueen.
As data services fail to make huge revenues and with regulatory and competitive pressures meaning the money people spend on voice and messaging is falling, operators need to make mobile TV a success, he said.
In Japan and South Korea there are now 5.8m people watching TV on their mobile phones, and even more watching TV on other hand-held devices and via in-car systems.
In Italy there are 500,000 subscribers to newly-launched mobile TV services such as that run by Vodafone in conjunction with Sky Italia.
The Vodafone service offers consumers the choice of 17 channels and can be paid for either monthly or is offered free for people that sign up to contracts.
For David McQueen, principal analyst with research firm Informa, mobile TV offers operators the chance to draw people away from increasingly popular pay-as-you-go services to the more profitable contract services.
                          Recording TV
The spectrum allocation issue is unique to the UK and it means the UK is behind in terms of mobile TV
                          David McQueen, Informa
There are a variety of ways to deliver TV to mobile phones and individual countries are adopting different technologies.
For example Vodafone's service in the UK is delivered via 3G which has a maximum capacity of around 15 users per 2km radius.
This means it would not be able to support mass market uptake, although it is ideally suited for offering 'catch-up' TV services such as that offered by 3.
By contrast, so-called broadcast TV has infinite capacity but cannot offer catch-up services, although there are now handsets coming on the market which are capable of recording TV.
Dave MacQueen believes that consumers are going to be most interested in watching simulcast TV, where the programming on mobile devices mirrors that of conventional TV.
This brings its own problems because peak viewing on conventional TV does not coincide with how people consume TV via their mobiles - mainly in short bursts early in the morning and on the way home from work.
It all makes for a confusing picture for consumers, say market watchers, and it gets even more complicated in the UK where true broadcast TV to mobiles will have to wait until spectrum is freed up in 2012.
"The spectrum allocation issue is unique to the UK and it means the UK is behind in terms of mobile TV," said Mr McQueen.

Research In Motion (RIM), maker of the popular BlackBerry smartphone, is the clear leader in business smartphone marketshare, and the Canadian company's dominance will continue throughout the second quarter of this year, according to a recent report. However, Apple and its iPhone wins the top slot in enterprise user satisfaction.

Seventy-three percent of the 2,013 IT decision makers queried by market research firm ChangeWave said their companies currently employ RIM BlackBerry devices. That percentage is unchanged since ChangeWave's last survey, in November, 2007, but RIM's lead over it closest competitor, struggling Treo-maker Palm, grew by a percentage point.
Palm has 18 percent of the market, Motorola has nine percent, Nokia has seven percent, and both Apple and Samsung have five percent, according to ChangeWave. (With the software development kit for the iPhone due this week, which will enable external developers to create business-specific applications, Apple's is sure to see an increase in the number of companies using its smartphones over the coming months and years, analysts say.)
ChangeWave also predicts that RIM's enterprise penetration will continue to increase through second quarter 2008, as 77 percent of respondents said they plan to buy RIM devices for future smartphone deployments. Apple will soon take the second place slot in business smartphone ranking, according to ChangeWave, with 11 percent of respondents saying their companies plan to purchase iPhones. Only eight percent of respondents said they plan to purchase Palm devices.

"What we have here is a huge and still growing market share lead for Research In Motion that for the moment appears near invincible," said ChangeWave Founder Tobin Smith in a release. "However, at the same time, we've picked up an unusual eight-point decline in the percentage of corporate customers who say they are 'Very Satisfied' with their RIM BlackBerry smartphones, which may mean that there's a problem brewing for the Canadian manufacturer."
Though Apple took a small sliver of the business smartphone market pie, its iPhone landed the leading spot in customer satisfaction with nearly 60 percent of respondents saying they are "very satisfied" with their Apple devices. RIM came in second place with 47 percent, which indicates an eight percent drop in user satisfaction since ChangeWave's November, 2007 survey. Nokia took third place with 40 percent, Samsung was fourth with 30 percent, Motorola took fifth place with 25 percent and Palm came in sixth with a mere 10 percent of users saying they were "very satisfied."

A related November, 2007 study from J.D. Power and Associates found that BlackBerry users were the most satisfied business customers due to the devices' ease of operation, operating system (OS), physical design, audio quality, battery life, and utility features.
For the survey, ChangeWave queried 2,013 members of its ChangeWave Alliance who are involved in IT decision making, fielding the research between Feb. 11 and Feb. 15. More information on the report is available on the ChangeWave website.

Polo Ralph Lauren to launch shopping by cell phone

Is the tech-savvy fashionista ready to shop by mobile phone? Polo Ralph Lauren Corp hopes so.

Polo is the first luxury retailer to launch a mobile commerce site, hoping to stay ahead of a trend that is making its way from Asia to the United States, said David Lauren, senior vice president of advertising and son of designer and Chief Executive Ralph Lauren.

Using phones to buy items such as train tickets or products in vending machines is commonplace in Japan, but the trend has yet to catch on in the United States.

"We recognize that in America this is going after somebody who is more comfortable with technology," Lauren told Reuters. "The truth is that in other countries, it's becoming a part of their culture. The trend is coming, and as a fashion company it's very important to identify trends and get ahead of them."

While early adopters of new technologies are often young, Lauren said the move is not aimed at a specific age group.

"This is about someone who's interested in our brand and interested in technology, and wherever the two meet, that's what's appropriate," Lauren said.

Polo, with its higher-end customers, has used cautious inventory management to outperform other apparel makers that have been hurt by a deteriorating U.S. economy.

The apparel maker will begin placing special codes in print ads, mailings and store windows along with its sponsorship of the U.S. Open tennis tournament, which begins later this month.
Shoppers can download special software to camera-phones to scan the codes and be directed to a phone-friendly version of a Ralph Lauren website, where they can shop, watch tennis videos and read company content.

Lauren declined to say how much the company invested in the new technology or its anticipated sales impact.

Cell phones with preinstalled code-readers should come to market within a year, Lauren said.
