Ironically, Iranian Land gave the world's first charter of human rights, it was by the emperor Cyrus the Great. Now the same land become barbarous than any land in the world for their own people.

generally, the victim's family was extremely ignorant and stupid. if this was not so, she would be alive right now.
How do you figure that????

-Role of family in murder trials in Islamic lawOriginally posted by Dokhtar Bandari View PostHow do you figure that????
the family is provided the opportunity under Islamic law to not attend the hanging, and this will prevent the hanging from occuring.
the family must approve of the hanging as the mode of gaining justice for their son, and they made a point of approving the hanging.
however, they were ofcourse under the naive belief that the laws in Iran are representative of the laws of God and they said they approved the hanging because there is no higher authority than God as seen in Sharia Law and as implemented in Iran's courts. i also believe they were incredibly weak and stupid, unable to understand morality in a situation.
-State's responsibility
this is not an excuse for the State to allow even the option, because the State is often responsible for humanity and even under a religious perspective it is hard to imagine this hanging should be approved. it is simply the way the technical law works in the area of murder in Islamic law. the victim's family is the judge. under some Islamic perspectives, however, the technical law should not be applied most of the time including such cases (eg as seen in statements by some Islamic reformers), or if applied, should be applied by a truly competent forum. therefore the execution was also a monopoly over a specific perhaps more fundamentalist interpretation of Islam itself.
another shortcoming in the State is seen in that the victim's family was stupid and uneducated. their statement that it was God's will shows they do not understand Islamic law and the option given to them to forgive the victim. All the State had to do was explain to them that the are allowed to forgive the crime (ofcourse assuming there was a crime, as the evidence was also flawed). I would imagine that the decision of the family must be educated/informed, and not influenced, even in Islamic law, before there is an execution.Last edited by zubin; 05-04-2009, 04:58 PM.Take him and cut him out in little stars,

What morality? that is a crock of shit as far as Sharia laws are concerned. So now we have an over zealous person who murdered a child and that is what it was, since she was under the court's stay from prosecution.
Now according to Sharia laws her parents should go after the person who hung her because that was a murder too...so what do we have here? An eye for an eye will leave everyone blind.
There is no justice and no morality in Islamic laws only savage attempts to degrade human beings. Human dignity is meaningless in Sharia Laws.
These evil-doers,
Who shall dwell in the abode of the Worst Mind,
Who yearn for ill-gotten gain, and seethe from discontent,
Who wantonly destroy life;
Away from Thy Prophet's message,
They shall not behold the Vision of Truth.
