    اصل مساوات اسلامى، به كلى با آن چه در فرهنگ مغرب زمين وجود دارد متفاوت است . از ديدگاه اسلام، انسان، اصولا موجود آلوده و گناه كارى نيست كه از فيض حلول به شايستگى مقام انسانيت را به دست آورد . قرآن، ارزش انسان را با مابعدالطبيعه نمى‏آميزد، انسان برتر، موجودى است كه آزادانه دستورات الهى را به كار بندد و خدا را پرستش كند


    اسلام و حقوق زن
    نزول كتاب آسمانى قرآن بر پيامبر صلى الله عليه و آله، تنها به خاطر تغيير رسوم و دگرگونى اخلاق عرب جاهليت نبوده است . قرآن، كتابى است‏حاوى دستورات منسجم و كامل كه اجراى آن در شرايط تاريخى و ضرورت‏هاى اجتماعى گوناگون كاملا امكان‏پذير است . در مورد حقوق زن، نخست‏بايد ديدگاه اسلام را در باره طبيعت زن دانست .

    ديانت اسلام، زنان و مردان را برابر مى‏داند و قوانين اسلام، عموما انسان را مورد حمايت قرار مى‏دهد نه فرد يا گروه معينى را . با اين همه در مواردى از حقوق زنان بيش‏تر پشتيبانى كرده و مخصوصا سنت پيامبر صلى الله عليه و آله عدالت، مهربانى و نيك رفتارى با زنان را توصيه نموده و احاديث‏بسيارى در اين باره موجود است . در مساله ازدواج كه از نظر اسلام، بعد اخلاقى و تربيتى آن اهميت فوق‏العاده‏اى دارد، اگر به مهريه تاكيد شده باز به خاطر احترام و تامين زندگى آينده زن بوده است .

    حديثى از پيامبر صلى الله عليه و آله نقل شده كه زن را به موجود مقدس تعبير كرده و در حديث ديگر مالكيت‏خصوصى، حق استفاده از ارث و تساوى در برابر قانون را براى زن قايل شده است .

    فقهاى اسلام، از تفاوتى كه در سهم ارث زن و مرد وجود دارد و مرد دو برابر زن ارث مى‏برد، بدين صورت دفاع كرده‏اند كه اين امر نه تنها تضييع حقى نسبت‏به زنان نيست، بلكه امتيازى هم براى آنان محسوب مى‏شود . مى‏دانيم كه در نظام اجتماعى اسلام، به طور كلى مرد مسؤول پرداخت هزينه خانواده از هر قبيل است . در حالى كه مسؤوليت و مديريت زن در خانواده نسبت‏به امورى است كه براى او مستلزم هزينه‏اى نيست، بدين ترتيب ثروت و در آمد او مانند مرد، صرف مخارج خانواده نمى‏شود . حال اگر، بيش‏تر از او ارث مى‏برد، هرگز به خاطر برترى مرد نسبت‏به زن نمى‏باشد، بلكه به علت مخارج بيش‏ترى است كه اجبارا مرد در زندگى برعهده دارد .

    از بررسى قرآن و احاديث پيامبر صلى الله عليه و آله به اين نتيجه مى‏رسيم كه دين اسلام سه نوع امتياز براى زنان قايل شده است:

    اول، حق زناشويى كه از نظر اسلام در عين اين كه پيوند معنوى و پرشكوه مرد و زن مسلمان است، اقدامى در مسير نظم جامعه و قرارداد عادلانه‏اى بين طرفين است .

    دوم، رعايت احترام و ادب معاشرت در روابط زن و مرد است . با شناختى كه اسلام از طبيعت‏سركش مردان داشته، در اين مورد راه‏هاى عملى ارايه داده و صرفا توصيه اخلاقى نكرده است .

    سوم، تنظيم روابط زناشويى است . زناشويى صرفا اقناع غريزه جنسى نبايد تلقى شود . انگيزه‏هاى انسانى و تربيتى، علل و موجبات اساسى زناشويى است . دورنماى اين مزاياى سه گانه كه با يك ديد كلى، مى‏توان آن‏ها را به صورت اصل واحدى پذيرفت، نظر اسلام را نسبت‏به ارزش مقام زن روشن مى‏سازد .

    مطالعه تاريخ تمدن‏هاى گذشته حاكى از پرداختن انسان به رسوم و عادات شرم‏آورى بوده كه انقلابات و تحولات اجتماعى نظير اسلام، سرانجام آن را از ميان برده است . از جمله اين عادات، رفتار غير انسانى مردان جاهليت‏با زنان و دختران عشيره بوده كه پيامبر با آن مبارزه كرده است .

    از ديدگاه قرآن، زن در جامعه مسلمان، از همگى حقوقى كه به مرد اختصاص داده شده، بهره‏مند است و اصولا هيچ گاه تفاوتى بين زن و مرد وجود ندارد .



    افسانه اغواگرى حوا و برانگيختن آدم به گناه كه در انجيل آمده، و زن را شاگرد شيطان ناميده است، مورد قبول اسلام نيست و اين بى‏احترامى نسبت‏به زن نه تنها در قرآن ديده نمى‏شود، بلكه به شهادت بعضى آيات، برترى زن نسبت‏به مرد، پذيرفته شده است . (14)

    در آيات مذكور، آسيه همسر فرعون و مريم دختر عمران و مادر عيسى عليه السلام نمونه پاكدامنى و استقامت در برابر شدايد و سختى‏ها معرفى شده‏اند . بنابر احاديث معتبر، خديجه همسر پيامبر صلى الله عليه و آله و فاطمه عليها السلام دختر پيامبر و همسر على عليه السلام در بزرگوارى همانند مريم و آسيه‏اند .     مبارزه‏اى كه زنان مسلمان براى به دست آوردن حقوق و آزادى خود آغاز كرده‏اند، از پيكار زنان اروپا و آمريكا، آسان‏تر است، زيرا زن مسلمان برخلاف زنان مغرب زمين عليه قوانين ظالمانه‏اى كه حقوق زنان را از ياد برده، قيام نكرده است، بلكه منحصرا با انديشه‏هايى مبارزه مى‏كند كه گرفتار كوته‏بينى و عصبيت‏هاى جاهليت‏اند و مانع رسيدن زنان به حقوق كه اسلام براى آنان پذيرفته است مى‏گردند .

    دين اسلام، به مراتب بيش‏تر از مسيحيت و اديان ديگر در مورد حقوق و آزادى‏هاى زن سخنى گفته است مانند: مالكيت‏خصوصى زن، مهريه، ارث، دريافت هزينه زندگى از شوهر سابق پس از طلاق، و امتيازات بسيار ديگر . دشوارى زن مسلمان و مقاومت مردانى است كه آماده اجراى احكام الهى در مورد او نيستند .

    در كدام سيستم اقتصادى، از حق مالكيت زن، نظير اسلام حمايت‏شده است؟ شور و حرارتى كه پيامبر صلى الله عليه و آله در دفاع از آزادى و حقوق اقتصادى و اجتماعى زن، در هزار و چهارصد سال پيش، نشان داده است، واقعا شگفت‏انگيز است . ظهور اسلام، مقارن با فرمانروايى امپراطوران روم و ايران بود كه اصولا مرد و زن از آزادى و عدالت‏بى‏بهره بودند . اروپاى قرن بيستم، هنوز حقوقى را كه اسلام براى زنان قايل شده است، به آنان نبخشيده است .



    تعدد زوجات و طلاق
    انكار نمى‏توان كرد كه اسلام حق چند همسرى را براى مرد پذيرفته و اجازه طلاق را به او داده است . بايد دانست كه نظر قرآن و روش پيامبر اسلام صلى الله عليه و آله در موضوع تعدد زوجات، مبتنى بر علل و موجباتى بوده كه در جامعه ابتدايى صدر اسلام وجود داشته است . نظام چند همسرى، ستم و اهانت و تحقير زن در عرب جاهلى، سنتى پا برجا و غير قابل انكار تلقى مى‏شد . هدف قرآن و پيامبر صلى الله عليه و آله از همان ابتدا، متوجه رفع ستم از زن و بهبود شرايط زندگانى او بوده است ولى عملى ساختن اين تصميم، با يك دستور قاطع و بى سابقه، با توجه به فضاى فكرى حاكم بر جامعه آن روز، امكان عقلى نداشته است . درست‏به همين علت، پيامبر اسلام صلى الله عليه و آله، با تدابير ويژه‏اى كوشيده است كه عادات ناپسند و غير انسانى چند همسرى را از جامعه اسلام زايل سازد و در راه رسيدن به اين هدف، نخستين گام را كه محدود ساختن تعدد زوجات و تدوين ضوابطى براى زناشويى و طلاق باشد برداشته است . در مراحل بعد، اسلام با هرگونه تبعيض و ستم، نسبت‏به انسان‏ها اعم از مرد و زن، سياه و سفيد، برده و آزاد، مبارزه كرده است .

    در مورد تعدد زوجات، هدف اسلام مبارزه با ستم‏گرى نسبت‏به زنان و اجراى عدالت‏بوده و مخصوصا پافشارى قرآن بر اجراى عدالت، خود به خود مساله چند همسرى را منتفى مى‏سازد . اگر عدالت و احترام بر روابط زن و شوهر سايه نيفكند، يقينا تك همسرى نيز تفاوتى با چند همسرى ندارد و به هر حال آرامش خانواده به نابودى كشيده مى‏شود .

    در باب طلاق هم اگر درست‏بنگريم، براى زن و شوهر هر دو حقوقى در نظر گرفته شده است . ازدواج در حقيقت نوعى قرارداد است كه زن و شوهر آن را امضا مى‏كنند . اين قرارداد در مواردى كه يكى از طرفين، به شرايط آن عمل نكند، قانونا نافذ نخواهد بود و اعتبار خود را از دست مى‏دهد . قرآن، درست هنگامى كه عقد زناشويى به اين مرحله از تزلزل برسد و تداوم زندگى مشترك ممكن نباشد، موضوع طلاق را (آن هم با شرايط عادلانه و در چند مرحله) مطرح مى‏سازد .

    در طلاق اسلام، صلح و آشتى و بازگشت‏به زندگى زناشويى پيش‏بينى شده و مخصوصا به زنان نيز، حق جدايى از شوهر، طبق شرايطى داده شده است . مرد به دل‏خواه خود و بدون دليل، هرگز نمى‏تواند همسر خود را طلاق دهد و در صورت طلاق شرعى، مرد مكلف است علاوه بر مهريه، ضرر و زيانى را كه همسر سابق او مطالبه مى‏كند، تمام و كمال بپردازد و رضايت‏خاطر او را فراهم آورد . در قرآن كريم سوره مستقلى به طلاق اختصاص داده شده و تمامى ابعاد آن با دقت نظر و موشكافى تجزيه و تحليل شده است . علاوه بر اين سوره (كه حاوى دستورالعمل‏هاى كافى براى شناسايى، حفظ و تامين حقوق مادى و معنوى بانوان است) در سوره‏هاى ديگر، ضمن آيات متعددى در موضوع نكاح و طلاق گفت‏وگو كرده است . با اين همه دين اسلام، طلاق را به جراحتى بر پيكر جامعه تعبير نموده است . و بر پايه اين تعبير، مقررات شديدى در راه تامين معيشت همسران مطلقه، وضع نموده تا به انحراف و فساد كشيده نشوند و جامعه را آلوده نسازند .

      مبانى و مزاياى حقوق بشر در اسلام

      ويژگى جهان شمولى اسلام



      در ارزيابى اين دو نظر، ناگزير بايد پرسيد چه ديانتى مى‏تواند از نظر گاه جهانى برخوردار باشد؟ شك نيست كه ديانت و هر نظام اجتماعى ديگرى را مى‏توان از ديدگاه‏هاى چهارگانه فلسفى، دينى، جامعه‏شناسى و سياسى بررسى كرد . از مجموع پژوهش‏هايى كه از جهات مذكور، در ايدئولوژى اسلام به عمل آمده ما را در اين باور راسخ‏تر ساخته كه اين ديانت مبتنى بر تفكر جهانى است .

      از نظر دينى، اعتقاد به يگانگى خداوند و برابرى انسان‏ها، نظر گاه جهانى به ايدئولوژى اسلام بخشيده است . به شهادت تاريخ، هميشه دين‏هاى يكتاپرست‏به دنبال تشكيل نظام يگانه‏اى در سراسر جهان بوده‏اند و تعاليم آن‏ها به صورت قانون ابدى و عمومى تجلى كرده است .

      از ديد فلسفى مزيت دين اسلام، نحوه برداشت و تلقى خاصى است كه از هويت انسان، در رابطه با نقش فردى و اجتماعى او به دست مى‏دهد . همان‏گونه كه فرد انسان با به كاربستن تعاليم قرآن، به سوى سعادت ابدى و تكامل معنوى مى‏رود، جامعه مسلمان نيز با پذيرش اصل برابرى و برادرى و تقويت روح تعاون به كمال مطلوب خود تواند رسيد . در اخلاق مسيحيت، تنها به حسن رابطه فرد تاكيد شده و از مسؤوليت اجتماعى او، حرفى به ميان نيامده است، ولى اخلاق اسلام، به دنبال هم بستگى و تفاهم جهانى است و از اين رو; بيش‏تر دستورالعمل‏هاى آن از كليت و شمول بهره‏مند است .

      از دلايلى كه نظرگاه جهانى اسلام را آشكار مى‏سازد، اهتمامى است كه پيامبر صلى الله عليه و آله در توسعه روابط مسلمين با اقوام غير مسلمان و مخصوصا يهوديان، پس از هجرت به مدينه معمول داشته است . پذيرش دين اسلام از سوى يهوديان، نيز برخلاف ادعاى بعضى، به خاطر فشار سياسى يا نظامى نبوده است .

      در قرآن آمده است كه انسان‏ها نخست نژاد واحدى بودند، سپس بنابر مشيت الهى، ملت‏ها، اقوام و نژادهاى گوناگون گرديدند . اين تنوع، به خاطر همبستگى و تفاهم متقابل انسان‏ها بوده است . قرآن نتيجه مى‏گيرد كه برترى انسان‏ها به فضيلت و تقوا است . اين دستورالعمل كلى، مى‏تواند رسالت جهانى اسلام را آشكار سازد .

      دليل ديگر بر جهان شمولى اسلام، آسان‏گيرى تعاليم قرآن است كه عمق بيش‏ترى به اين ديانت‏بخشيده است . از سوى ديگر هر انسانى در هر نقطه عالم، تنها با اداى شهادتين، به آسانى مى‏تواند در زمزه مسلمانان قرار گيرد .

      نظرگاه جهانى اسلام، با دو امتياز نيرومند، درخششى ويژه دارد، نخست: ايمان به خدا و دوم: انكار هرگونه برترى قومى و قبيله‏اى و تاكيد بر برابرى انسان‏ها . با اعلام اين اصول، پيامبر توانسته است عصبيت قومى و نژادى عرب جاهلى و اقوام يهود و مشركان مكه را، ريشه كن سازد .

      فرد مسلمان در حالى كه به سرزمين خود عشق مى‏ورزد، در آرزوى گسترش جهانى اسلام است . اعتقاد به يگانگى خدا و برابرى انسان‏ها با هرگونه نژادپرستى و ناسيوناليسم افراطى مبارزه كرده است

              امريكا و اقليت مسلمان


              هدف اين مقاله، تبيين پيامدهاي حوادث 11 سپتامبر سال 2001، بر مواضع دولت و جامعه آمريكا، نسبت به مسلمانان، به عنوان يكي از اقليت‌هاي تشكيل دهنده‌ي جامعه اين كشور است. براي رسيدن به هدف مقاله، لازم است مقدمه‌ي كوتاهي را بيان كنيم و درباره‌ي گزينه‌هاي بنيادين پيشروي دولت‌ها و جامعه‌ها، براي ايجاد تعامل با اقليت‌هاي تشكيل دهنده‌ي جامعه، مطالبي را مطرح كنيم.


              هدف اين مقاله، تبيين پيامدهاي حوادث 11 سپتامبر سال 2001، بر مواضع دولت و جامعه آمريكا، نسبت به مسلمانان، به عنوان يكي از اقليت‌هاي تشكيل دهنده‌ي جامعه اين كشور است. براي رسيدن به هدف مقاله، لازم است مقدمه‌ي كوتاهي را بيان كنيم و درباره‌ي گزينه‌هاي بنيادين پيشروي دولت‌ها و جامعه‌ها، براي ايجاد تعامل با اقليت‌هاي تشكيل دهنده‌ي جامعه، مطالبي را مطرح كنيم.

              در اين نوشته، راهكارهاي مزبور، ضمن پنج گزينه‌ي اصلي، يعني استبعادگرايي، تسامح، تلفيق، آميختگي و تكثرگرايي خلاصه شده است. سپس به تبيين وضعيت تكثرگرايي موجود در آمريكا، پيش از وقايع 11 سپتامبر پرداخته و روشن كرده‌ايم كه اين حوادث زماني به وجود آمد كه اختلاف درباره‌ي اقليت‌هاي و تأثير آنها بر جامعه‌ي آمريكايي بالا گرفته بود؛ بر همين اساس، در بخش پاياني، واكنش دولت و جامعه‌ي آمريكا در مواجهه با اقليت مسلمان آمريكايي پس از سپتامبر بررسي مورد بررسي قرار گرفته است.

              مفاهيمي بنيادين از استبعاد تا تكثرگرايي

              دولت‌ها و جوامع، تعامل خود را با اقليت‌هاي تشكيل دهنده‌ي خويش، در قالب چندين گزينه‌ي اساسي ساماندهي مي‌كنند. گزينه‌ي نخست كه بيشترين تاثير منفي را دارد، استبعادگرايي است. منظور از اصطلاح پيش گفته اين است كه اكثريت، وجود گروه‌هاي متعدد درون جامه را منكر شود. نتيجه اين گرايش، تلاش استبعادگرايان براي ريشه‌كن كردن گرو‌هاي متفاوت با خود است.





              تسامح از نظرگاه "ديانا اك" در بيشتر مواقع، از موضع‌ قدرت پديد مي‌آيد؛ نه از موضع ضعف، گاهي تسامح، اكثريت را به حالت خودانتقادي و عدم تجاوز به اقليت‌ها سوق مي‌دهد اولي نمي‌تواند موجب ايجاد فهم و احترام دوسويه شود. همچنين بنا به ديدگاه "ليوريبفو" پيوند تسامحي، پيوندي سست است و ممكن است در دوران بحران و حوادث بزرگ قوميتي مانند حادثه‌ي 11 سپتامبر، از بين برود.



              اقليت‌هاي سه‌گانه پيش گفته، از گروه‌هاي نژادي متفاوتي تشكيل شده‌اند. براي مثال از مسلمانان به اقليتي ديني تعبير مي‌شود كه بيشترين تكثر دروني را دار است، زيرا مسلمانان آمريكا اكثريت را تشكيل مي‌دهند اگر ادعا نكنيم كه به طور تقريبي اين اكثريت نسبت به تمام كشورهاي جهان است. براي اين كه اقليتي مانند مسلمانان در جامعه آمريكا به مرحله تلفيق برسد، بايد سطحي از هماهنگي دروني را در ميان خود به وجود آورد. نخست بايد هويت مشتركي را ميان اعضاي اين جامعه گسترده شود تا مسلمانان خود را به عنوان گروهي داراي هويت مشترك ببينند نه اين كه گروه‌هاي گوناگون و متفاوت نژادي، ملي و فرهنگي در ميان مسلمانان پديدار گردد. وقتي اين هماهنگي به وجود آمد، مسلمانان خواهند توانست در جامعه آمريكا به عنوان اقليت يكپارچه اسلامي، به مرحله تلفيق برسند.

              نكته‌ي باقي مانده اينكه تلفيق هر اقليتي در جامعه آمريكايي، هديه‌ي اكثريت به اقليت، به شمار نمي‌رود. تلفيق بعد از مبارزه و تلاش فراوان سياسي و اقتصادي به وجود خواهد آمد. مهارت تاريخي آفريقاييان آمريكا و مبارزه آنان براي به دست آوردن حقوق شهروندي خود، بهترين دليل بر اين مدعاست.

              گزينه‌ي چهارم، آميختگي است. اين گزينه را بسياري از كساني كه قصد دارند اقليت‌ها را در سطوح فرهنگي، ديني و نژادي استحاله كنند، مي‌پسندند. اين هدف، با انجام ازدواج و تبليغات ديني و فشار فرهنگي به دست مي‌آيد. آميختگي گزينه برگزيده حاكم در آمريكا تا نيمه‌ي دوم قرن بيستم بود. آنان جامعه‌ي آمريكايي را كوره‌اي مي‌ديدند كه وظيفه‌ي آميخته كردن نژاد اقليت‌هاي گوناگون و تبديل آن به بافت جديد آمريكايي را بر عهده دارد.



              براي مثال كوره آميخته‌سازي آمريكايي به شكل تاريخي در آميخته كردن پيشينه نژادي و ملي مهاجران اروپايي ساكن در آمريكا موفق گشته است. با گذشت زمان ديگر خاطره‌اي از هويت‌هاي ملي مهاجران اروپايي به آمريكا، به ياد نمي‌آيد؛ مانند هويت ايتاليايي يا انگليسي يا فرانسوي و آلماني، زيرا فرزندان اين هويت‌ها، در اكثريت سفيد‌پوست آمريكايي استحاله شده‌اند؛ با اين حال، همين كوره آميخته‌سازي در تغيير ديني اين مهاجران و يكسان‌سازي دين آنان شكست خورده است، زيرا اديان بزرگ سنتي آمريكا مانند پروتستان، كاتوليك و يهوديت همچنان پابرجا و موثر باقي مانده است.

              گزينه‌ي پنجم كه تاثير مثبت بسياري دارد، گزينه تكثرگرايي است. در اينجا منظور از تكثرگرايي اين است كه به اقليت‌ها اجازه داده شود در جامعه در قالب‌هاي سياسي و اقتصادي تلفيق گردند و در بزرگترين نهادهاي جامعه‌اي كه در آن زندگي مي‌كنند، مشاركت نمايند بدون اين كه مجبور باشند از فرهنگ و دين خود به نفع فرهنگ و دين حاكم بر جامعه دست بردارند.



              به همين جهت تحليل‌گرايي مانند "بريما كورين"، استاد جامعه‌شناسي دانشگاه سيركيوس آمريكا، تا اندازه‌اي براي اين كشور عذر مي‌آورند؛ به اين جهت كه آمريكا كشوري است كه بيشترين حالت تكثرگرايي به را به ويژه در زمينه ديني دارا است. تا جايي كه اديان بزرگ آمريكايي مانند مسيحيت به شكل دروني بالاترين درجه هاي تكثرگرايي را دارا هستند.

              در پايان، لازم است به حقيقت مهمي اشاره كنيم. تعيين كننده‌ي وضعيت اقليت‌ها در هر جامعه و موضع آن جامعه نسبت به اقليت‌ها (استبعاد، تسامح، تلفيق و ...)، در حقيقت نهادهاي بزرگ آن جامعه و در رأس همه‌ي آنها، نهادهاي سياسي، قانونگذاري و دولت است؛ براي مثال اگر دولتي شكل بگيرد و قصد سياست‌گذاري يا تصويب قوانيني داشته باشد كه به ساماندهي وضعيت اقليت‌ها بينجامد، قاعدتاً اين قوانين تاثير زيادي بر وضعيت اقليت‌هاي جامعه خواهد گذاشت.

              اين ديدگاه نقش حاكميت را برابر حاكميت، در فرآيند تلفيق، كم‌رنگ نشان نمي‌دهد. جامعه نيز با افراد و نهادهاي مدني خود، نقش بزرگي را در گسترش تفاهم و احترام دوسويه ميان گروه‌هاي تشكيل دهنده‌ي آن بازي مي‌كند؛ ولي وقتي تبعيض در قوانين دولت و نهادهاي بزرگ دولتي و همچنين در ميان نخبگان حاكم رسوخ پيدا كند، دشوار است كه جامعه بتواند به تنهايي وحدت مطلوب را به وجود بياورد.

                تكثرگرايي امريكايي پيش از 11 سپتامبر

                "چارلز هيرشمان"، استاد دانشگاه واشنگتن معتقد است كه جامعه‌ي آمريكايي در آغاز متسامح يا دين‌دار نبود. نسبت دينداران در جامعه آمريكا، در سال‌هاي پاياني قرن 18 از يك پنجم تجاوز نمي‌كرد. همچنين تسامح ديني ويژگي حاكم بر پيروان اديان آمريكايي نبوده است. برخي فرقه‌‌هاي ديني پروتستان كه از اروپا به دنبال به دست‌آوري آزادي ديني، به دنياي جديد مهاجرت كرده بودند، به هيچ وجه با ديگران تسامح نداشتند. به همين دليل يهوديان، كاتوليك‌ها و فرقه‌هاي مسيحي ديگر (غير از پروتستان)، دچار تبعيض‌هاي فراواني گشتند؛ به همين دليل، هيرشمان معتقد است كه عامل فعال شدن كليسا‌هاي آمريكايي‌ها به دين، در حقيقت همان جنگ پيوسته‌ي فرقه‌هاي ديني در آمريكا است. همچنين اين حالت موجب شده كه فرقه‌هاي ديني تحت فشار، براي به دست آوردن آزادي ديني بيشتر، مطالبات خود را مطرح كنند. به همين جهت آزادي و تكثرگرايي آمريكايي، پيامد ستيز ميان فرقه‌هاي ديني آمريكايي است؛ نه اين كه تكثرگرايي موجود، علت پديد آمدن ستيز فرقه‌ها باشد. همچنين هيرشمان معتقد است كه تعصب ديني در آمريكا تنها بيانگر نوعي تعصب نژادي است.

                بعد از مبارزه‌اي طولاني، اقليت‌هاي ديني مانند كاتوليك‌ها و يهوديان، و اقليت‌هاي نژادي چون آفريقايي‌ها و آسيايي‌ها آمريكايي، توانستند حقوق و آزادي‌هاي بيشتري را در جامعه‌ي آمريكايي به دست آورند؛ هر چند به مقدار زيادي دچار آميختگي فرهنگي شدند.

                انقلاب مدني آمريكايي، در نيمه دهه شصت قرن بيستم به اوج خود رسيد. اين حالت موجب شد كه جامعه‌ي آمريكايي از چندين دگرگوني فرهنگي، اجتماعي و سياسي كلان گذر كند از جمله: جنگ ويتنام، انقلاب آفريقاييان آمريكايي براي به دست آوردن حقوق شهروندي خود، گسترش انقلاب فرهنگي و انديشه‌هاي چپ در ميان جوانان آمريكايي، اين انديشه‌ها، جامعه آمريكا را به دست خودانتقادي بيشتر سوق داد.

                همچنين اين دگركوني‌ها باعث افزايش تگثرگرايي در آمريكا شد. اين تكثرگرايي با باز شدن دروازه‌هاي مهاجرت به سوي آمريكا مرتبط شد. "بريما كورين" درباره اين مساله به دگرگوني قوانين مهاجرت در سال 1965 م اشاره مي‌كند به گونه‌اي كه باعث شد ساليانه نزديك به هفتصد هزار مهاجر جديد به آمريكا وارد شود. تنها در دهه نود، نه ميليون مهاجر وارد آمريكا شده است. با توجه به سير معكوس نسبت مواليد در جامعه آمريكا، آمارهاي كنوني بيان مي‌كند كه يك پنجم آمريكاييان جديد از مادراني خارجي به دنيا آمده‌اند. اين نسبت در مناطقي كه مهاجران متمركز هستند افزايش مي‌يابد. 77% مهاجران در آمريكا در شش ايالت اصلي آمريكا يعني كاليفرنيا، نيويورك، تگزاس، فلوريدا، نيوجرسي و آلينوي ساكن هستند.

                "كورين" معتقد است دهه‌هاي اخير شاهد يكي از بزرگترين امواج مهاجرت به آمريكا بوده است. روشن است كه اين موج نو در مقايسه با موج‌هاي گذشته از حقوق و آزادي‌هاي بيشتري برخوردار بوده. اين بهره‌مندي بيشتر به جهت پديد آمدن علت‌هاي متعددي است كه نخستين علت آن تكثرگرايي فرهنگي حاكم بر آمريكا از دهه شصت مي‌باشد. اين حالت اقليت‌ها و مهاجران جديد را تشويق نموده هويت‌هاي فرهنگي و دوگانگي خود را حفظ كنند و استحاله شدن در جامعه آمريكايي را نپذيرند. بايد اين عامل، پيشرفت وسايل ارتباطي را نيز افزود چرا كه اين پديده، فرآيند ارتباط مهاجران به وطن و فرهنگ اصيل‌شان را آسان ساخته است. مساله مهم ديگر كه عامل سوم به شمار مي‌رود، پديده بازگشت دين است كه در آمريكا و جهان از دهه هفتاد در قرن بيستم گسترده شده است. " "هيرشمان" معتقد است دين و دين‌داري نقش روزافزوني را در تشكيل پيوند مهاجران جديد با جامعه آمريكايي داشته است. جامعه آمريكايي با مرور زمان بيشتر ديندار شده است علاوه بر اين، اديان ذوب شدن را نمي‌پذيرند و مانعي قوي در برابر كوره ذوب‌سازي دين خواهند بود.

                ويژگي نهادهاي ديني در آمريكا، دارا بودن ميزان بالايي از توانايي و درآمد است. اين نهادها كاملا مستقل از حاكميت هستند. در عين حال قدرتمندند و براي جذب دينداران جديد رقابت مي‌كنند. به همين جهت نهادهاي ديني آمريكايي تا اندازه زيادي به خدمت‌رساني اجتماعي و فرهنگي و در برخي موارد اقتصادي، به مهاجران جديد پرداخته‌اند. به جهت غربت و نيازمندي اين مهاجران جديد كه همچنان در فرهنگ و زبان مادري خود مستحكم هستند، اين نهادهاي ديني، پناهگاهي اساسي براي آنان به شمار مي‌آيد.



                از سوي ديگر اوج‌گيري عوامل پيش گفته كه توجه به تكثرگرايي را در جامعه آمريكايي بيشتر كرده، با پيدايش عوامل متضاد ديگري در همين دوران مرتبط است. اين عوامل در طول دو سده اخير، آغاز به شكل‌گيري كرده است. مي‌توان اين عوامل را با پديده رشد جناح راست آمريكايي، به ويژه برخي گروه‌هاي راستگرا كه تكثرگرايي را براي جامعه خطرناك مي‌دانند، مرتبط دانست.





                پديده‌ي رشد راستگرايي در امريكا، طي دو دهه‌ي اخير، در قالب پديده‌هاي متعددي آشكار شده است؛ از جمله گسترش دينداري، رشد نفوذ سياسي گروه‌هاي متدين مسيحي، تلاش اين گروه‌ها براي ايجاد تشكل سياسي، رشد نفوذ جمهوري‌خواهان در پارلمان و مجلس سناي آمريكا، گسترش نظريات راستگرايانه در سطح اخلاق آمريكايي و محبوبيت برخي انديشمندان مخالف با مهاجرت و تكثرگرايي.

                نكته‌ي مهم اين است كه اين عوامل با حوادث 11 سپتامبر مرتبط نبوده است. عوامل پيش گفته علت‌هايي ريشه‌اي است كه طي سده‌هاي متعدد به وجود آمده است. به همين دليل حوادث 11 سپتامبر در خلاء پديد نيامده، بلكه در جامعه‌اي به وجود آمد كه دوره‌اي از ستيز نيروهاي راستگرا در حال رشد و نيروهاي چپ حاكم در دهه شصت را تجربه كرده بود.

                  مسلمانان و تكثرگرايي امريكايي بعد از 11 سپتامبر



                  در بخش گذشته وضعيت تكثرگرايي در جامعه آمريكا را پيش از وقايع 11 سپتامبر، شرح داديم. در اين دوره به اندازه زيادي، نگاه باز و آزادي به دست آمده توسط اقليت‌هاي آمريكايي را مشاهده مي‌كنيم كه اين امتيازها بعد از مبارزه‌اي طولاني از نيمه دهه شصت قرن بيستم به دست آمده بود و توضيح داديم چگونه اين تكثرگرايي آمريكايي، در دو دهه قرن بيستم، با رشد نيروهاي راستگراي آمريكايي، مورد تهديد قرار گرفت.

                  وقايع 11 سپتامبر، دست كم به دو علت اساسي، اين تهديد ها را افزايش داد:

                  1. حوادث 11 سپتامبر و جنگ با تروريسم، هر دو، نقش جامعه را در رويارويي با دولت آمريكا كاهش داد. اين كاهش مواجهه، عكس‌العملي متناسب با دوره‌هاي بحران بود كه افزايش نفوذ دولت و نقش آن را در جهت‌دهي و به كارگيري توانايي‌هاي جامعه مي طلبيد.

                  اين پديده، مطالبات را براي دخالت دولت و قوه مجريه به جهت تامين امنيت ملي آمريكا، افزايش داد. تا جايي كه نظرسنجي كه مركز پژوهش‌هاي دانشگاه كورنيل آمريكا در اواخر سال گذشته انجام داد 44% آمريكايي‌ها معتقدند كه حكومت آمريكا بايد حقوق شهروندي مسلمانان آمريكا را محدود نمايد.

                  2. رشد نوعي ملي‌گرايي آمريكايي خطرناك كه به تركيب مسايل ديني با نوعي احساسات و انديشه‌هاي سطحي و آرماني قوميتي پرداخته است. در اين گرايش، مردم آمريكا خود را ملتي آرماني و داراي رسالت نيكي مي‌بينند و در عين حال خود را قرباني نفهمي‌هاي ديگران مي‌دانند. "آناتول ليفين" پژوهشگر دانشكده كانرنيگي مركزي كه درباره‌ي مسائل مربوط به صلح به پژوهش مي‌پردازد) معتقد است كه خطر اين گرايش قوميتي، در سادگي و آميختگي‌اش با مسايل ديني نهفته است. اين گرايش به آساني مي‌تواند مورد سوءاستفاده سياستمداران آمريكايي (براي بسيج كردن ملت آمريكا بر ضد مخالفان داخلي و خارجي)، قرار بگيرد.

                  در سايه‌ي عوامل و شرايط پيش گفته، مي‌توان ادعا كرد كه وضعيت مسلمانان به عنوان اقليتي در درون جامعه‌ي آمريكا، در سه سطح اساسي، از حوادث 11 سپتامبر متأثر شده است:

                  در سطح مثبت، به رسميت شناختن اسلام و مسلمانان و نهادهاي ديني اسلامي به عنوان بخش‌هاي اساسي جامعه آمريكا، اين به رسميت‌شناسي از سوي بالاترين سطوح رهبري سياسي آمريكا از جمله رييس‌جمهور آمريكا مطرح شد كه باعث خشمگين شدن برخي رهبران تندروي راستگرا گرديد.

                  مي‌توان گفت، اين بحران باعث افزايش احساس هويت از سوي مسلمانان آمريكا شد و نيازمندي به همبستگي و همكاري با يكديگر و همچنين فعاليت در سطوح سياسي و حقوقي را براي دفاع از حقوق و آزادي‌هايشان بيشتر درك كردند.

                  از جنبه‌ي منفي نيز اين بحران باعث ادعاهاي گروه‌هاي مخالف با تكثرگرايي، اقليت‌ها و مهاجران بيشتر شود. در اين جا لازم است توضيح دهيم كه ادعاهاي منفي اين گروه‌ها، تنها مسلمانان را هدف نگرفته بلكه در برخي موارد اقليت‌هاي ديگر آمريكايي مانند مهاجران آمريكاي لاتين را بيشتر تحت فشار قرار مي دهد. ساموئل هانتينگتون، در كتاب پيش گفته، به دليل حجم بالاي مهاجرت از سوي آمريكاي لاتين و سرعت رشد جمعيت آنان در مقايسه با اقليت‌هاي ديگر، به شكل مبنايي اين مهاجرت‌ها را هدف حمله قرار داده است.

                  مشكل اين است كه فشارها و لهجه‌ي دشمني كه نسبت به مسلمانان در آمريكا اعمال مي شود به هيچ‌وجه با حجم حضور آنان در آمريكا متناسب نيست. همان‌گونه كه برخي نويسندگان مانند "آناتول ليفين" معتقدند، از دشمني با اسلام به بدترين شكل سوءاستفاده مي‌شود و براي توجيه انديشه‌هاي راستگراي تندرو، خطر اسلام بزرگنمايي مي‌گردد. هانتينگتون در آخرين كتاب خود، به روشني اين ديدگاه را مطرح كرده است. او در بسياري از بخش‌هاي كتابش، از خطر اساسي مهاجرت‌هاي آمريكاي لاتين براي جامعه‌ي آمريكايي سخن مي‌گويد؛ اما علي‌رغم اين مطلب، در پايان كتاب، اين ديدگاه را ترويج مي‌كند كه دشمني اسلام مي‌تواند وسيله‌اي براي همبستگي آمريكايي‌ها پيرامون هويت خود ياشد.

                  گزارش‌هاي مربوط به حقوق شهروندي مسلمانان در آمريكا، بيانگر حقيقت مهم ديگري است كه بايد به اين مسئله افزود و آن نيز افزايش تبعيض بر ضد حقوق مسلمانان آمريكايي از سوي نهادهاي دولتي و قوه مجريه است. جديدترين گزارش‌هاي ويژه درباره حقوق مسلمانان در آمريكا در سال 2003 ميلادي توسط "انجمن ارتباطات اسلامي آمريكا" (يكي از بزرگترين نهادهاي حقوق مدني مسلمانان آمريكا) تهيه شده است. اين گزارش بيانگر اين نكته است كه تا سال 2002 ميلادي، محل‌هاي كار، نخستين منبع اعمال تبعيض بر ضد مسلمانان به شمار مي‌آمد. براساس گزارش اين انجمن، در همين سال، نسبت تبعيض مراكز كاري بر ضد مسلمانان، با نسبت تبعيض نهادهاي دولتي، به عنوان منبع نخست اعمال تبعيض مساوي شد؛ ولي در سال 2003 ميلادي، نهادهاي دولتي با كسب 29 درصد از نسبت حوادث تبعيض‌آميز بر ضد مسلمانان، در مرتبه‌ي نخست و مراكز كار با كسب آمار 33 درصد، در مرتبه دوم قرار گرفتند.

                  عامل چهارم اينكه وقايع سپتامبر، فرصتي را براي گرايش‌هاي استبعادي و دشمني با مسلمانان آمريكا فراهم آورد تا به شكل كلي مسلمانان غرب و به شكل خاص مسلمانان آمريكا را به عنوان گروه‌هايي معرفي كنند كه تلفيق با جوامع غربي را نمي‌پذيرند و ارزش‌هايي متعارض با آزادي و تكثرگرايي دارند. استبعاد‌گرايان انديشه‌ي تلفيق مسلمانان در جوامع غربي زا به شكل مبناي رد مي كنند، بلكه تفكر استبعادگرايان، در بيشتر اوقات، انان را به سوي اعمال تبعيض بر ضد مسلمانان و تجاوز به حقوق‌شان مي‌كشاند.

                  در نهايت ضروري است بيان كنيم كه چهره‌ي حقيقي پيامدهاي وقايع 11 سپتامبر، بر موضع جامعه‌ي امريكا نسبت به اقليت مسلمان اين كشور، هنوز به شكل كامل شفاف نشده است. چند سال آينده، در وضوح اين چهره، نقش مهم و موثري خواهد داشت. همچنين، مسلمانان آمريكا، در برابر حوادث دست روي دست نخواهند گذاشت و فعاليت آنان، در اين برهه، براي دفاع از حقوق و جايگاه مسلمانان در جامعه‌ي آمريكا، بيشترين تاثير را بر موضع جامعه‌ي آمريكايي نسبت به مسلمانان طي چند سال آينده خواهد داشت

                    Etymology
                    In Arabic islām derives from the triconsonantal root Sīn-Lām-Mīm, with a basic meaning of "to surrender; to obey". Islām is an abstract nominal derived from this root, and literally means "submission to ' The God ' (Allah)". Other Arabic words derived from the same root include:

                    Salām, meaning "peace", also part of a common salutation, As-Salāmu alaykum ("Peace be upon you").
                    Muslim, an agentive noun meaning "one who submits [to God]"
                    Salāmah, meaning "safety," also used in the common farewell ma' as-salāmah ("[go] with safety").

                    Beliefs

                    Basic Muslim Beliefs





                    Muslims hold that Islam is essentially the same belief as that of all the messengers sent by God to humanity since Adam, with the Qur'an (the text used by all sects of the Muslim faith) codifying the final revelation of God. Islamic texts depict Judaism and Christianity as derivations of the teachings of Abraham and thus acknowledge common Abrahamic roots. The Qur'an calls Jews and Christians (and sometimes people of other faiths) "People of the Book." Historically, the second Caliph Umar ibn Khattab created what came to be known as "the Pact of Umar" in establishing that any people of the book who submitted to Muslim authority as dhimmis during the wars of Muslim expansion retained their freedom of religion and their existing churches.


                    Six articles of belief
                    Islām is described as a dīn, meaning "way of life" and/or "guidance". There are six basic beliefs shared by all Muslims:

                    Belief in God, the one and only one worthy of all worship (tawhid).
                    Belief in the Angels (mala'ika).
                    Belief in the books (kutub) sent by God:
                    The Suhuf-i-Ibrahim (Scrolls of Abraham);
                    The Tawrat sent to Musa (Moses);
                    The Zabur sent to Daud (David);
                    The Injil sent to Isa (Jesus);
                    The Qur'an sent to Muhammad.
                    Belief in all the prophets (nabi) and messengers (rasul) sent by God (see Prophets of Islam) (making no distinction between them i.e. one is not better then another.)
                    Belief in the Day of Judgement (qiyama) and in life after death - heaven (jannah) and hell (jahannam).
                    Belief in Fate (qadar).
                    The Muslim creed in English:

                    "I testify that there is no god but God Almighty, Who is One (and only One) and there is no associate with Him; and I testify that Muhammad (peace and blessings of God be upon him), is His Messenger."
                    "I believe in God; and in His Angels; and in His Scriptures; and in His Messengers; and in The Final Day; and in Fate, that All things are from God, and Resurrection after death be Truth."


                    The tenets of Islam

                    The Pilgrimage (Hajj) to Kaaba, Masjid al Haram, Mecca, is one of the five pillars of Islam or one of the roots of religion (for the Shi'a).The two largest subgroups of the Muslims are the Sunni and the Shi'a. Sunni Muslims make up the largest percentage of the Muslim world, although large majorities of Shi'a Muslims are found in Middle Eastern countries such as Iran and Iraq. However, in countries such as Saudi Arabia, Indonesia, and Pakistan, Sunni Muslims are the majority.



                    Shahādah: Testifying that there is none worthy of worship except God (Tawheed) and that Muhammad is his servant and messenger (Nubuwwah).
                    Salah: Performing the five daily prayers.
                    Sawm: Fasting from dawn to dusk in the month of Ramadan.
                    Zakāt: Giving Zakaah (charity).
                    Hajj: The Pilgrimage to Mecca during the month of Dhul Hijjah, which is compulsory once in a lifetime for one who has the ability to do it.
                    Shi'a and Sunni also agree on the following beliefs, although they classify them differently:

                    Adl: The justice of God.
                    Qiyamah: The Day of Resurrection.
                    Amr-Bil-Ma'rūf: Commanding what is good.
                    Nahi-Anil-Munkar: Forbidding what is evil.
                    Al Jihad fi sabilillah: Striving to seek God's approval.
                    Distinctive Shi'a beliefs, not held by the Sunni, include:

                    Imamah: Leadership. The belief in the divinely appointed and guided imamate of Ali and some of his descendants.
                    Khums: Paying the tax on profit.


                    As for those who divide their religion and break up into sects, thou hast no part in them in the least: their affair is with God. He will in the end tell them the truth of all that they did. (6:159)



                    God

                    Allah, God, Islamic concept of God

                    The fundamental concept in Islam is the oneness of God (tawhid). This monotheism is absolute, not relative or pluralistic in any sense of the word. God is described in Sura al-Ikhlas, (chapter 112) as follows:

                    Say "He is God, the one and only. God, the Eternal, Absolute the Self-Sufficient master. He begetteth not, nor is he begotten. And there is none like unto Him."
                    In Arabic, God is called Allāh. The word is etymologically connected to ʾilāh "deity", Allāh is also the word used by Christian and Jewish Arabs, translating ho theos of the New Testament and Septuagint; it predates Muhammad and in its origin does not specify a "God" different from the one worshipped by Judaism and Christianity, the other Abrahamic religions.



                    "(He is) the Creator of the heavens and the earth: He has made for you pairs from among yourselves, and pairs among cattle: by this means does He multiply you: there is nothing whatever like unto Him, and He is the One that hears and sees (all things)" (42:11).
                    The implicit usage of the definite article in Allah linguistically indicates the divine unity. Muslims believe that the God they worship is the same as the Judeo-Christian God, i.e. the God of Abraham. However, Muslims reject the Christian theology concerning the trinity of God (the doctrine of the Trinity which regards Jesus as the eternal Son of God), seeing it as akin to polytheism. Quoting from the Qur'an, sura An-Nisa(4:171):

                      "O People of the Scripture! Do not transgress the limits of your religion, and do not say about God except the truth. The Messiah, Jesus the son of Mary, was only a messenger of God, and His word that He had sent to Mary, and a revelation from Him. Therefore, you shall believe in GOD and His messengers. You shall not say, "Trinity". You shall refrain from this for your own good. God is only one God. Be He glorified; He is much too glorious to have a son. To Him belongs everything in the heavens and everything on earth. God suffices as Lord and Master."
                      No Muslim visual images or depictions of God are meant to exist because such artistic depictions may lead to idolatry and are thus disdained. Such aniconism can also be found in Judeo-Christian theology. Moreover, most Muslims believe that God is incorporeal, making any two- or three- dimensional depictions impossible. Instead, Muslims describe God by the many divine attributes mentioned in the Qur'an. All but one Sura (chapter) of the Qur'an begins with the phrase "In the name of Allah, the Beneficent, the Merciful". These are regarded as the most important divine attributes, at least in the sense that Muslims repeat them most frequently during their prayers (salat) and throughout their daily lives.

                      The Qur'an

                      Muslims believe that the Qur'an was revealed to Muhammad by God through the Angel Gabriel on numerous occasions between the years 610 and up till his death in 632. In addition to memorizing his revelations, his followers are said to have written them down on parchments, stones, and leaves.
                      Muslims hold that the Qur'an available today is the same as that revealed to Muhammad and by him to his followers, who memorized and wrote down his words. Scholars generally accept that the version of the Qur'an used today was first compiled in writing by the third Caliph, Uthman ibn Affan, sometime between 650 and 656. He sent copies of his version to the various provinces of the new Muslim empire, and directed that all variant copies be destroyed. However, some skeptics doubt the recorded oral traditions (hadith) on which this account is based, and will concede only that the Qur'an must have been compiled before 750.
                      There are numerous traditions, and many conflicting academic theories, as to the provenance of the Qur'anic verses that were eventually assembled into a single volume. (This is covered in greater detail in Qur'an). Most Muslims accept the account recorded in several hadith, which state that Abu Bakr, The First Caliph, ordered his personal secretary Zayd ibn Thabit to collect and record all the authentic verses of the Qur'an, as preserved in written form or oral tradition. Zayd's written collection, privately treasured by Muhammad's wife Hafsa bint Umar, was, according to Muslim sources, later used by Uthman and is thus the basis of today's Qur'an.
                      Uthman's version, organized the suras roughly in order of length (excepting the brief opening sura Al-Fatiha), with the longest suras at the start of the Qur'an and the shortest ones at the end. More conservative views state that the order of most suras was divinely set. Later scholars have struggled to put the suras in chronological order, and at least among Muslim commentators, there is a rough consensus as to which suras were revealed in Mecca and which at Medina, with distinctive characteristics observed within these two subgroups. Some suras (e.g. surat Iqra) are thought to have been revealed in parts at separate times.
                      To understand the notion of "variants" within the received Qur'anic text, one must understand that Arabic had not yet fully developed as a written language. The Qur'an was first recorded in written form (date uncertain) in the Hijazi, Mashq, Ma'il, and Kufic scripts; these scripts write consonants only and do not supply vowels. (Imagine an English text that wrote the word 'bed' as "BD," and required the reader to infer, from context, that the reference was to "bed" - and not to 'bad" or "bide.") Because there were differing oral traditions of recitation as non-native Arabic speakers converted to Islam, there was some disagreement as to the exact reading of many (vowel-free) verses. Eventually, scripts were developed that used diacritical markings (known as points) to indicate the vowels. For hundreds of years after Uthman's recension, Muslim scholars argued as to the correct pointing and reading of Uthman's (unpointed) official text. [3] Eventually, most commentators accepted seven variant readings (qira'at) of the Qur'an as canonical, while agreeing that the differences among the seven are minor and do not affect the meaning of the text.
                      The Qur'an early became a focus of Muslim devotion and eventually a subject of theological controversy among skeptics. In the 8th century, the Mu'tazilis claimed that the Qur'an was created in time and was not eternal. Their opponents, of various schools, claimed that the Qur'an was eternal and perfect, existing in heaven before it was revealed to Muhammad. The Ashari theology (which ultimately became predominant) held that the Qur'an was uncreated.
                      Most Muslims regard paper copies of the Qur'an with extreme veneration, wrapping them in a clean cloth, keeping them on a high shelf, and washing as for prayers before reading the Qur'an. Old Qur'ans are not destroyed as wastepaper, but buried in soil.
                      Most Muslims memorize for personal contact at least some portion of the Qur'an in the original language. Those who have memorized the entire Qur'an are known as hafiz (plural huffaz). This is not a rare achievement; it is believed that there are millions of huffaz that are alive today.
                      From the beginning of the faith, most Muslims believed that the Qur'an was perfect only as revealed in Arabic. Translations were the result of human effort and human fallibility, as well as lacking the inspired poetry believers find in the Qur'an. Translations are therefore only commentaries on the Qur'an, or "interpretations of its meaning", not the Qur'an itself. Many modern, printed versions of the Qur'an feature the Arabic text on one page, and a vernacular translation on the facing page.







                      Organization
                      Religious authority
                      There is no official authority who decides whether a person is accepted into, or dismissed from, the community of believers, known as the Ummah ("family" or "nation"). Islam is open to all, regardless of race, age, gender, or previous beliefs. It is enough to believe in the central beliefs of Islam. This is formally done by reciting the shahada, which should be made sincerely from the heart, the statement of belief of Islam, without which a person cannot be classed a Muslim. It is enough to believe and say that one is a Muslim, and behave in a manner befitting a Muslim to be accepted into the community of Islam.
                      Islamic Law
                      Sharia
                      The Sharia (Arabic for "well-trodden path") is Islamic law, as elaborated by traditional Islamic scholarship. The Qur'an is the foremost source of Islamic jurisprudence. The second source is the sunnah of Muhammad and the early Muslim community. The sunnah is not itself a text like the Qur'an, but is extracted by analysis of the hadith (Arabic for report), which contain narrations of the Muhammad's sayings, deeds, and actions. Ijma (consensus of the community of Muslims) and qiyas (analogical reasoning) are the third and fourth sources of Sharia.

                      In current times, not all Muslims understand the Qur'an in its original Arabic. Thus, when Muslims are divided in how to handle situations, they seek the assistance of a mufti (Islamic judge) who can advise them based on Islamic Sharia and hadith.

                        Apostasy and Blasphemy
                        Apostasy in Islam
                        Local Islamic communities may exclude those they regard as apostates and blasphemers. In states following more austere versions of Islamic law, apostacy from Islam and blasphemy are considered crimes and may be punished with execution or imprisonment.
                        Islamic calendar
                        Islam dates from the Hijra, or migration from Mecca to Medina. Year 1, AH (Anno Hegira) corresponds to AD 622 or 622 CE, depending on the notation preferred (see Common era). It is a lunar calendar, but differs from other such calendars (e.g. the Celtic calendar) in that it omits intercalary months, being synchronized only with lunations, but not with the solar year, resulting in years of either 354 or 355 days. Therefore, Islamic dates cannot be converted to the usual CE/AD dates simply by adding 622 years. Islamic holy days fall on fixed dates of the lunar calendar, which means that they occur in different seasons in different years in the Gregorian calendar.
                        Schools (denominations)
                        Divisions of Islam
                        There are a number of Islamic religious denominations, each of which has significant theological and legal differences from each other but possess identical essential belief. The major schools of thought are Sunni and Shi'a, with Sufism considered as a mystical inflection of Islam, but is also referred to as a separate text. According to most sources, present estimates indicate that approximately 85% of the world's Muslims are Sunni and approximately 15% are Shi'a. [4]
                        Sunni
                        The Sunni are the largest group in Islam. In Arabic, as-Sunnah literally means principle or path. Sunnis and Shi'a believe that Muhammad is a perfect example to follow, and that they must imitate the words and acts of Muhammad as accurately as possible. In fact, the Qur'an states that the character of Muhammad was a good example to follow. Because of this reason, the Hadith in which those words and acts are described are a main pillar of Sunni doctrine.
                        Sunnis recognize four legal traditions (madhhabs): Maliki, Shafi'i, Hanafi, and Hanbali. All four accept the validity of the others and Muslims choose any one that he/she finds agreeable to his/her ideas. There are also several orthodox theological or philosophical traditions (kalam).
                        Shi'a
                        A view of the Dome of the Rock on the Temple Mount in Jerusalem, a holy site in IslamShi'a Muslims, the second-largest branch, differ from the Sunni in rejecting the authority of the first three caliphs. They honor different traditions (hadith) and have their own legal traditions. Shi'a scholars have a larger authority than Sunni scholars and have greater room for interpretation. The Imams play a central role in Shi'a doctrine. Shi'a Muslims hold that Muhammad, his daughter Fatima and the twelve descendants of Muhammad, the Imams, were all sinless and pure. This is based on Qur'anic verses (such as 33:33) and Hadith narrations such as the Event of the Cloak.
                        The Arabic word Shi'a literally translates into the word 'supporters' or 'followers'. Originally known as Shi'at ul Ali (the supporters of Ali), the group formed shortly after the death of Ali, in Iraq. Ali ibn Abi Talib was the cousin of prophet Muhammad, and after marriage to Fatima, he also became Muhammad's son-in-law. Muhammad was raised in the house of Abi Taleb after he became an orphan; therefore he and Ali were raised as brothers.
                        The Shi'a consist of one major school of thought known as the Ithna 'ashariyah or the "Twelvers", and a few minor schools of thought, as the "Seveners" or the "Fivers" referring to the number of infallible leaders they recognize after the death of prophet Muhammad. The term Shi'a, when used without qualification, is usually taken to be synonymous with the Ithna Ashariyya or Twelvers. Most Shi'a live in Iran, Iraq (the country where Ali died), Bahrain, Lebanon, India, Azerbaijan, Yemen and Pakistan. A minority group (about 4 million) of Shi'a is known as Ismaili. The Shia Ismaili branch is subdivided into Nizari Ismaili and Mustaali Bohra subbranches. The Nizari Ismaili or are led by the Aga Khan and are found mainly in Pakistan, Tajikistan, Bangladesh, India, Canada and United States, although the modern day practices of this branch are very different from that of the mainstream Twelvers. The Mustaali Bohra branch is further subdivided into Dawoodi and Sulaimanis subsects. The Dawoodi Bohras are concentrated in Pakistan and India. The Sulaimani Bohras are concentrated in Yemen and Najran province of Saudi Arabia.

                        Sufism
                        Sufism is a spiritual practice followed by both Sunni and Shi'a. Sufis generally feel that following Islamic law or jurisprudence (or fiqh) is only the first step on the path to perfect submission; they focus on the internal or more spiritual aspects of Islam, such as perfecting one's faith and fighting one's own ego (nafs). Most Sufi orders, or tariqas, can be classified as either Sunni or Shi'a. However, there are some that are not easily categorized as either Sunni or Shi'a, such as the Bektashi. Sufis are found throughout the Islamic world, from Senegal to Indonesia. However, Sufis are often criticised for innovative beliefs and actions, by Wahhabis who consider their practices to be against the letter of Islamic law.
                        Others
                        Wahhabis, as they are known by non-Wahhabis, are a smaller, more recent Sunni group. They prefer to be called Salafis. Wahhabism is a movement founded by Muhammad ibn Abd al Wahhab in the 18th century in what is present-day Saudi Arabia. They are classified as Sunni and claim to follow (mostly) the Hanbali legal tradition. The major trend, however, is the abolition of these "schools of thoughts" (legal traditions), and the following of Muhammad directly through the study of the sciences of the Hadith (prophetic traditions). The Hanbali legal tradition is the recognized official school of Islamic law in Saudi Arabia and they have had a great deal of influence on the Islamic world because of Saudi control of Mecca and Medina, the Islamic holy places, and because of Saudi funding for mosques and schools in other countries. The majority of Saudi Islamic scholars are considered as Wahhabis by other parts of the Islamic world.

                        Another sect which dates back to the early days of Islam is that of the Kharijites. The only surviving branch of the Kharijites are the Ibadi Muslims. Ibadhism is distinguished from Shiism by its belief that the Imam (Leader) should be chosen solely on the basis of his faith, not on the basis of descent, and from Sunnism in its rejection of Uthman and Ali and strong emphasis on the need to depose unjust rulers. Ibadi Islam is noted for its strictness, but, unlike the Kharijites proper, Ibadis do not regard major sins as automatically making a Muslim an unbeliever. Most Ibadi Muslims live in Oman.
                        Another trend in modern Islam is that which is sometimes called progressive. Followers may be called Ijtihadists. They may be either Sunni or Shi'ite, and generally favor the development of personal interpretations of Qur'an and Hadith. See: Liberal Islam
                        One very small group, based primarily in the United States, follows the teachings of Rashad Khalifa and calls itself the "Submitters". They reject the Hadith and Fiqh, and say that they follow the Qur'an alone. They also consider Khalifa a messenger after Muhammad (Rashad Khalifa proclaimed himself the Messenger of the Covenant). Note that this is different to a Prophet. Neither the "Submitters" nor Rashad Khalifa believe there will be any more prophets after Muhammed. Most Muslims of both the Sunni and the Shia branches consider this group to be heretical. Some Muslims, however, will reject Khalifa's messenger status but will also reject both the Fiqh and the Hadith.

                          The Qur'an contains both injunctions to respect other religions, and to fight and subdue unbelievers. Some Muslims have respected Jews and Christians as fellow "people of the book" (monotheists following Abrahamic religions), while others have reviled them as having abandoned monotheism and corrupted their scriptures. At different times and places, Islamic communities have been both intolerant and tolerant. Support can be found in the Qur'an for both attitudes.

                          The medieval Islamic state was often more tolerant than many other states of the time, which insisted on complete conformity to a state religion. The record of contemporary Muslim-majority states is mixed. Some are generally regarded as tolerant, while others have been accused of intolerance and human rights violations. See the main article, Islam and other religions, for further discussion.
                          History
                          History of Islam
                          Islamic history begins in Arabia in the 7th century with the emergence of Muhammad. Within a century of his death, an Islamic state stretched from the Atlantic ocean in the west to central Asia in the east, which, however, was soon torn by civil wars (fitnas). After this, there would always be rival dynasties claiming the caliphate, or leadership of the Muslim world, and many Islamic states or empires offering only token obedience to an increasingly powerless caliph.
                          Nonetheless, the later empires of the Abbasid caliphs and the Seljuk Turks were among the largest and most powerful in the world. After the disastrous defeat of the Byzantines at the Battle of Manzikert in 1071, Christian Europe launched a series of Crusades and for a time captured Jerusalem. Saladin, however, restored unity and defeated the Shiite Fatimids.
                          From the 14th to the 17th centuries, one of the most important Muslim territories was the Mali Empire, whose capital was Timbuktu.
                          In the 18th century, there were three great Muslim empires: the Ottoman in Turkey, the Middle East, and the Mediterranean; the Safavid in Iran; and the Mogul in India. By the 19th century, these realms had fallen under the sway of European political and economic power. Following WWI, the remnants of the Ottoman empire were parceled out as European protectorates or spheres of influence. Islam and Islamic political power have revived in the 20th century. However, the relationship between the West and the Islamic world remains uneasy.
                          Contemporary Islam

Green represents a Sunni majority and blue represents a Shia majority.Although the most prominent movement in Islam in recent times has been fundamentalist Islamism, there are a number of liberal movements within Islam, which seek alternative ways to align the Islamic faith with contemporary questions.                           Early Sharia had a much more flexible character than is currently associated with Islamic jurisprudence, and many modern Muslim scholars believe that it should be renewed, and the classical jurists should lose their special status. This would require formulating a new fiqh suitable for the modern world, e.g. as proposed by advocates of the Islamization of knowledge, and would deal with the modern context. One vehicle proposed for such a change has been the revival of the principle of ijtihad, or independent reasoning by a qualified Islamic scholar, which has lain dormant for centuries.
                          This movement does not aim to challenge the fundamentals of Islam; rather, it seeks to clear away misinterpretations and to free the way for the renewal of the previous status of the Islamic world as a centre of modern thought and freedom.                           The demographics of Islam today

                          Based on the percentages published in the 2005 CIA World Factbook ("World"), Islam is the second largest religion in the world. According to the World Network of Religious Futurists, the U.S. Center for World Mission, and the controversial Samuel Huntington, Islam is growing faster numerically than any of the other major world religions. Ontario Consultants on Religious Tolerance estimate that it is growing at about 2.9% annually, as opposed to 2.3% per year global population growth. Non-Muslim observers attribute this growth to the higher birth rates in many Islamic countries (six out of the top-ten countries in the world with the highest birth rates are majority Muslim [5]). A recent demographic study, however, has determined that the birth rates of some Muslim countries are plummeting to the levels of western countries [6].
                          The most exact calculations estimate Islamic population to be a little over 1.3 billion. Commonly cited estimates of the Muslim population today range between 900 million and 1.4 billion people (cf. Adherents.com); estimates of Islam by country based on U.S. State Department figures yield a total of 1.48 billion, while the Muslim delegation at the United Nations quoted 1.2 billion as the global Muslim population in September 2005.
                          Only 18% of Muslims live in the Arab world; 20% are found in Sub-Saharan Africa, about 30% in the South Asian region of Pakistan, India and Bangladesh, and the world's largest single Muslim community (within the bounds of one nation) is in Indonesia. There are also significant Muslim populations in China, Europe, Central Asia, and Russia.
                          France has the highest Muslim population of any nation in Western Europe, with up to 6 million Muslims (10% of the population [7]). Albania is said to have the highest proportion of Muslims as part of its population in Europe (70%), although this figure is only an estimate (see Islam in Albania). The number of Muslims in North America is variously estimated as anywhere from 1.8 to 7 million.

                              رابطه حقوق با دين ويژگى هاى عمده حقوق بين الملل

                              مجموعه اصول و مقرراتى كه امروزه بر سراسرجهان حاكم است ومعروف به حقوق بين الملل مى باشد ويژگى هايى دارد كه در كتاب ها كم و بيش مورد توجه قرار گرفته است.20 در اين جا، به مناسبت، به دو ويژگى عمده آن به اختصار اشاره مى گردد:





                              اولاً، ديوان بين المللى دادگسترى، خود را نماينده و معرّف انواع مهم تمدن ها و نظام هاى حقوقى اصلى جهان معرفى مى كنند و با عنايت به نقش ارزش هاى فرهنگى در حقوق بين الملل، لزوم رعايت تنوع فرهنگى بين ملت هاى جهان را توسط ديوان يادآور مى گردد.

                              ثانياً، قواعد و مقرراتى را كه ديوان در دعاوى مطرح شده اعمال مى كند، قواعد و مقررات جهانى نيست كه از لحاظ فرهنگى خنثى و بدون جهت گيرى نباشد. اثر فرهنگى در اين نظام حقوقى، آن را به نحوى جلوه گر ساخته كه حاوى كنش ها و روابط متقابل فرهنگ ها باشد.
                              با عنايت به نكات مزبور، به خصوص دو ويژگى عمده حقوق بين الملل، جايگاه و نقش دين در توسعه حقوق بين الملل تبيين مى گردد:

                                عربستان پيش از اسلام
                                الف ـ احترام به مكان هاى خاص ب ـ تكيه بر اصول شورا ج ـ اصل حكميت و داورى د ـ اصول و مقررات جنگى

                                اعراب با وجود داشتن روحيه سلحشورى و جنگ طلبى، مقرراتى را درباره جنگ مراعات مى كردند; ازجمله ممنوعيت جنگ در ماه هاى حرام كه اين كار تا حدى مشقات قبايل غيرمتحد را تقليل مى داد. كسانى كه حرمت اين كار را مراعات نمى كردند، نزد همه قبايل عرب محكوم بودند.


                                هــ ممنوعيت جنگ قبل از اعلان و احترام به اجساد كشتگان دشمن

                                عده اى معتقدند كه اين اصل به احتمال قوى در ميان اعراف پيش از اسلام وجود داشته است. از جمله شواهدى كه ذكر كرده اند، اين داستان است: خواهر عمرو بن عبدود، جنگجوى معروف عرب، وقتى متوجه شد كه امام على(ع) لباس از تن برادرش درنياورده است، گفت: از كشته شدن برادرم هرگز تأسف نمى خورم; زيرا به دست فرد كريمى كشته شده است، وگرنه تا زنده بودم، اشك مى ريختم.


                                و ـ نظام ايلاف يا ميثاق (الأيلاف و العهود)

                                نظام ايلاف يكى از اصول حقوق ملل عربستان بود كه توسط اهل مكّه توسعه يافت. به موجب اين نظام، آن ها در ازاى عبور دادن كاروان هاى تجارى از سرزمين خود، مصونيت كامل دريافت مى كردند. افراد متنفّذ مكّه به قبايل زيادى كه در مسيرهاى تجارى از قلمرو آنان عبور مى كردند، اطمينان مى دادند كه اجناسشان را به عنوان نماينده آنان بدون پرداخت عوارض بازرگانى حمل كنند و يا معاهدات دوستى براى عبور سالم از قلمرو خودشان منعقد مى كردند. خدمات اين تشكيلات حتى براى خارجيان نيز به شرط پرداخت اجرت، قابل استفاده بود.32 اعراب نظام حفاظتى را به شكل ظريفى توسعه دادند، چنان كه در رشد بازرگانى و امنيت بازرگانان نقش فوق العاده اى داشت.


                                ز ـ تبادل نماينده و سفير

                                در كتب تاريخى، نوشته هاى فراوانى در خصوص رفتن نمايندگان عرب، اعزامى به نزد فرمان روايان ديگر ممالك و آمدن سفراى آنان به عربستان وجود دارد; مثلاً، يمنى ها فرستاده اى به تيسفون، پايتخت ساسانيان اعزام كردند تااز ايرانيان براى مقابله با حبشه كمك بطلبند.


                                ح ـ رعايت مراسم خاص در هنگام امضاى عهدنامه ها

                                ادعا نمى شود كه اين ها شكل كاملى از روابط بين المللى است، بلكه غرض بيان زمينه هايى است كه مى تواند به اين هذف منتهى شود. بدون ترديد، اصول و قواعد حاكم بر روابط قبايل عرب و اجراى تشريفات،جنبه مذهبى داشتوشايداعراب اين مسائل را احكام شريعت حضرت ابراهيم(ع) مى دانستند و به همين دليل، به آن اهميت مى دادند. اما بايد توجه داشت كه زندگى قبيله اى آن ها نيز يك چنين چيزى را اقتضا داشت و مطمئناً از جهات متعددى آن ها از يونانيان نيز پيشرفته تر بودند; زيرا مراعات اين مقررات را درباره همه انسان ها از عرب و غيرعرب لازم مى دانستند، در حالى كه يونانيان همه امتيازات را خاص خود مى شمردند و در جنگ با ديگران، صرفاً مسائل اقتصادى و قدرت طلبى را در نظر داشتند.33


                                ط ـ حلف الفضول (پيمان جوان مردى) ى ـ حقوق جنگ

                                گفته اند كه در عربستان، حقوق حاكم بر جنگ پيشرفته تر از ساير موارد بوده است; مثلاً، اعلان جنگ، رفتار با اسيران جنگى، توزيع غنايم، مزاياى خاص فرمانده سپاه و جاسوسان، رهائن (گروگان ها)، جنگ و آتش بس، مذاكره درباره صلح موقت و مانند آن تا حدودى به صورت منظم مراعات مى گرديد.37
